Are You Ready for the Changes 2010 Will Bring for Employers?
The legal and political developments over the past year will make 2010 another year of change for employers. A new administration in Washington, the further shift of power in Congress, and the highly anticipated healthcare reform…are you ready?
This 2010 Employment Law Update will address pending law changes in labor legislation and leave laws, healthcare reform legislation, the enforcement strategy of OSHA, and laws that affect government contractors.
Traditional Labor Law. Due to the lack of progress with passing the Employee Free Choice Act or the RESPECT Act, unions are getting restless. Expect this to change in 2010.
Employee Leave Rights. Extending leave rights for employees is one of the Obama Administration's key objectives. A comprehensive leave act similar to the Balancing Act of 2009 could be passed. This legislation would expand FMLA's scope and coverage. The Paid Vacation Act could also amend the Fair Labor Standards Act.
Occupational Safety and Health. There is an increase in enforcement activities by OSHA and this is expected to continue into 2010, focusing on non-compliant employers. Congress could also pass the Protecting America's Workers Act to substantially amend OSHA.
Healthcare. In 2009, the Senate and the House approved an $871 billion version of healthcare reform. While significant differences remain in the House and Senate versions, proponents of health care reform are pushing to pass a bill early this year. Expect massive change in this area in 2010.
Government Contracts. The Department of Labor has targeted "government contractors," who are subjected to more than 60 different laws or executive orders.
